1. ACCEPTANCE OF TERMS

By accessing or using Moonlight (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must discontinue use of the Service immediately.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Moonlight ("we", "us", or "our"). Your continued use of the Service following any modifications to these Terms constitutes acceptance of such changes.

2. SERVICE DESCRIPTION

Moonlight is a Discord bot service that provides various features including but not limited to:

2.1. Voice channel management and moderation tools

2.2. Music integration with Last.fm and Spotify

2.3. Server management and automation features

2.4. Premium subscription services with additional functionality

2.5. Custom commands and server configuration options

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

3. USER OBLIGATIONS

By using the Service, you agree to:

a) Comply with all applicable laws and regulations, including Discord's Terms of Service and Community Guidelines

b) Use the Service only for lawful purposes and in accordance with these Terms

c) Not engage in any activity that interferes with or disrupts the Service

d) Not attempt to gain unauthorized access to any portion of the Service

e) Not use the Service to transmit malicious code, spam, or harmful content

f) Not reverse engineer, decompile, or disassemble any aspect of the Service

4. PROHIBITED CONDUCT

Users are strictly prohibited from:

4.1. Using the Service to harass, abuse, or harm others

4.2. Attempting to exploit vulnerabilities or bypass rate limits

4.3. Spamming commands or flooding the Service

4.4. Impersonating Moonlight staff or other users

4.5. Using automated systems or bots to access the Service

4.6. Reselling, redistributing, or commercializing the Service without authorization

4.7. Using the Service for any illegal activities or fraudulent purposes

Violation of these prohibitions may result in immediate termination of access to the Service without notice or refund.

5. PREMIUM SERVICES AND BILLING

5.1. Subscription Plans

Moonlight offers premium subscription plans with enhanced features. All subscription fees are processed securely through Stripe, our third-party payment processor.

5.2. Payment Terms

a) All fees are stated in United States Dollars (USD)

b) Payment information is securely stored and processed by Stripe

5.3. Refund Policy

Premium purchase is generally non-refundable. However, refunds may be issued at our sole discretion within seven (7) days of the initial purchase where required by applicable law. Refund requests must be submitted to [email protected].

6. ACCOUNT TERMINATION AND SUSPENSION

We reserve the right to suspend or terminate your access to the Service, with or without notice, for any of the following reasons:

a) Violation of these Terms of Service

b) Fraudulent, abusive, or illegal activity

c) Chargebacks or payment disputes

d) Behavior that negatively impacts the Service or other users

e) At our sole discretion for operational or security reasons

Termination of access does not entitle you to a refund of any fees paid. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

7. INTELLECTUAL PROPERTY

All intellectual property rights in the Service, including but not limited to software, graphics, logos, designs, text, and functionality, are owned by or licensed to Moonlight. These Terms do not grant you any rights to use our trademarks, service marks, or logos.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service unless expressly permitted by applicable law.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

a) The Service will be uninterrupted, secure, or error-free

b) Defects will be corrected

c) The Service is free of viruses or other harmful components

d) Results obtained from using the Service will be accurate or reliable

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOONLIGHT AND ITS DEVELOPERS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

a) Your access to or use of or inability to access or use the Service

b) Any conduct or content of any third party on the Service

c) Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100 USD), whichever is greater.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Moonlight and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. THIRD-PARTY SERVICES

The Service integrates with third-party platforms including Discord, Spotify, Last.fm, and Stripe. Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.

12. MODIFICATIONS TO SERVICE

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13. AMENDMENTS TO TERMS

We may revise these Terms at any time by updating this page. Material changes will be communicated via email or Discord notification where practicable. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically for changes. The "Effective Date" at the top of this document indicates when these Terms were last revised.

14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Moonlight operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

15. SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
